Advocacy group sues NC DMV claiming discrimination

RALEIGH, NC (AP) — An advocacy group representing disabled people is suing the N.C. Division of Motor Vehicles, charging the agency discriminates against drivers with disabilities.

The lawsuit was filed Tuesday by Disability Rights NC, and it alleges that drivers with disabilities are subjected to unnecessary road testing and medical exams, based on stereotypes and generalizations about people with physical disabilities. The group says DMV is in violation of the Americans with Disabilities Act and the Rehabilitation Act.

Executive Director Vicki Smith said the plaintiffs were referred for testing or medical review by DMV staff based on its policies toward drivers with disabilities. She said the drivers were capable and safe.

A statement from DMV said attorneys are reviewing the claims, and the division will work to resolve the matter as quickly as possible.
